The EB-5 Immigrant Investor Program

Our firm has had many years experience preparing and filing visas through the EB-5 Immigrant Investor Program. The EB-5 is a subcategory of immigrant visas that is an option for those looking to establish or invest in a business in the U.S.

The EB-5 visa was created to help stimulate the economy by creating job growth. Foreign investors, their spouses and unmarried children under the age of 21 are eligible to apply. The EB-5 investor must create and maintain a new commercial enterprise that will create and maintain or preserve at least 10 full time jobs for qualifying U.S workers within two years. Indirect job creation is a hallmark of another EB-5 program called a Regional Center.

In order to establish a qualifying enterprise in the U.S. you must invest at least $1 million in capital that you are primarily and personally liable for. However, if you establish your enterprise in an area that is categorized as a high unemployment or a rural area, known in EB-5 circles as a Targeted Employment Area (TEA) you may invest a minimum of $500,000. In addition to direct investments you can invest in a pre-certified investment program/project known as a Regional Center. A Regional Center program is typically a multi-million dollar project aggregating the investments of many EB-5 investors.
